An Exhibit subscription includes access to the private GitHub repository, allowing you to self-host Exhibit on your own Google Cloud environment.
Exhibit Source Available Licence Agreement
This agreement ("Licence") governs the use of the Licensed Software and is between Mnemoscene Ltd ("Licensor") and the institution, organisation or individual accessing or using the Licensed Software ("Licensee").
By accessing or using the Licensed Software, the Licensee agrees to the terms below.
1. Licence Grant
The Licensor grants the Licensee a non exclusive, non transferable, source available licence to:
- Use, modify and deploy the Licensed Software for internal academic, research, cultural or organisational purposes.
- Run public facing websites that support the Licensee's own activities, provided they are hosted and operated by the Licensee.
- Make internal changes such as branding, layout or CSS modifications.
- Operate multiple deployments for internal collections or sites, provided these remain part of the Licensee's own activities.
The grant above covers non commercial use.
Use of the Licensed Software for any production deployment requires an active annual subscription purchased through the Licensor's approved channels.
2. Restrictions
2.1 Redistribution and disclosure
The Licensee may not:
- Redistribute, publish or share the source code or derivative works outside the organisation.
- Expose the source code in public deployments or through public repositories.
- Sub licence, sell, lease or provide the Licensed Software to third parties except where you are acting as an authorised reseller under a valid Reseller Addendum and the licence is assigned to a named End Client.
- Use the Licensed Software to provide hosted services for third parties.
2.2 Competition
The Licensee may not use the Licensed Software or derivative works to create products or services that directly or indirectly compete with Exhibit or other Mnemoscene products.
2.3 Circumvention
The Licensee may not attempt to bypass subscription requirements or technical controls that relate to paid features or production use.
3. Ownership
The Licensed Software and all related intellectual property rights remain the property of the Licensor. This Licence does not transfer ownership or create any assignment of rights.
4. Contributions
4.1 Submitting contributions
If the Licensee or its contractors submit code, improvements or feature changes to the Licensor, the Licensor may include them at its discretion.
4.2 Licensing of contributions
Contributors agree that:
- They have the right to submit the contribution.
- The contribution does not infringe the rights of others.
- The contribution is licensed to the Licensor on the same terms as this Licence unless otherwise agreed in writing.
5. Attribution
The Licensee must retain visible attributions in the default configuration of the Licensed Software unless the Licensor agrees otherwise in writing.
6. Support and Updates
This Licence does not include support, maintenance or updates. These are provided only under a separate support and maintenance agreement.
Access to updates, patches and security fixes requires an active subscription.
7. Disclaimer
The Licensed Software is provided "as is" without any warranty. The Licensee accepts all risks associated with the use, deployment or modification of the Licensed Software.
8. Limitation of Liability
The Licensor is not liable for:
- Direct, indirect or consequential losses.
- Loss of data, business interruption or loss of use.
- Any claim arising from use or inability to use the Licensed Software.
9. Termination
This Licence terminates automatically if the Licensee breaches any of its terms.
Upon termination the Licensee must:
- Cease using the Licensed Software.
- Delete all copies, including modified versions.
10. Governing Law
This Licence is governed by the laws of the United Kingdom. Disputes will be resolved in UK courts.
11. Entire Agreement
This Licence contains the full agreement between the parties regarding the Licensed Software. Changes must be made in writing and agreed by both parties.
